1. About these Terms
These Terms of Service govern your access to and use of PipeBandHQ, including its website, applications and related services.
By creating an account or using PipeBandHQ, you agree to these Terms.
If you use PipeBandHQ on behalf of a pipe band, organisation or other entity, you confirm that you are authorised to accept these Terms on its behalf.
2. The service
PipeBandHQ provides online tools intended to assist pipe bands and organisations with activities including member management, events, attendance, rehearsals, communications, music, documents, finances and organisation administration.
Features may be changed, added or removed as the service develops.
3. Accounts
You must provide accurate information when creating and using an account.
You are responsible for keeping your login credentials secure and for activity carried out using your account.
You must notify us promptly if you believe your account has been accessed without authorisation.
4. Organisations and administrators
PipeBandHQ allows organisations to appoint administrators, committee members and other users with different levels of access.
Organisation administrators are responsible for deciding who should have access to their organisation and what permissions those users should receive.
PipeBandHQ is not responsible for decisions made by an organisation administrator regarding membership, permissions, committee appointments or access to organisation information.
5. Your content and data
You and your organisation retain ownership of information and content that you submit to PipeBandHQ.
You grant PipeBandHQ the limited rights necessary to host, process, store, display, transmit and back up that information for the purpose of providing and operating the service.
You are responsible for ensuring that you have the right and lawful authority to upload or enter information into PipeBandHQ.
6. Member information
Organisations may use PipeBandHQ to store information relating to their members.
Each organisation is responsible for ensuring that the information it enters is collected and used lawfully and that access is granted only to appropriate users.
7. Acceptable use
You must not use PipeBandHQ:
- For unlawful, fraudulent or abusive purposes.
- To harass, threaten or harm another person.
- To upload malicious code, viruses or harmful software.
- To attempt to gain unauthorised access to accounts, systems or information.
- To interfere with the operation or security of the service.
- To upload information that you do not have the right to process or share.
- To copy, reverse engineer or misuse the platform except where permitted by law.
8. Subscriptions and payment
Certain PipeBandHQ services may require a paid subscription.
Subscription prices, billing periods and included features will be displayed before a paid subscription is started.
Where subscriptions renew automatically, you authorise the applicable payment method to be charged at the beginning of each billing period until the subscription is cancelled.
Payments may be processed by a third-party payment provider. Additional terms imposed by that provider may apply.
9. Member payments to organisations
Organisations may allow their members to pay for events, trips, transport and similar charges by card through PipeBandHQ.
Card payments made by members through PipeBandHQ are processed by PipeBandHQ using our payment provider and passed on to the organisation, less the card processing fee charged by our payment provider. PipeBandHQ does not currently charge an additional fee on these payments.
The member is credited with the full amount they paid. The card processing fee is a cost to the organisation, not an amount owed by the member.
Organisations are responsible for any refunds to their members. Refunds are made by the organisation directly, for example by bank transfer, and recorded in PipeBandHQ. PipeBandHQ does not make refunds on behalf of organisations. Card processing fees are not returned when a payment is refunded.
Organisations are responsible for any payment disputes or chargebacks relating to payments made to them, including any dispute fees. Where a dispute or chargeback occurs, PipeBandHQ may recover the disputed amount and associated fees from the organisation, including by deducting them from future payments.
Organisations should keep records of any refunds they make, such as the date and reference of a bank transfer, as these may be needed to respond to a dispute.
Organisations may also record payments received outside PipeBandHQ, such as cash or bank transfer. These payments are not processed by PipeBandHQ.
10. Cancellation
Paid subscriptions may be cancelled in accordance with the cancellation options made available within PipeBandHQ or by contacting us.
Unless otherwise stated, cancellation prevents future renewal but does not normally provide a refund for a billing period that has already begun.
Any mandatory rights available to consumers under applicable law are not affected by these Terms.
11. Fees and price changes
We may change subscription prices or available plans from time to time.
Where appropriate, existing paying customers will be given reasonable notice before a price change applies to their future billing periods.
12. Availability of the service
We aim to keep PipeBandHQ reliable and available, but we do not guarantee uninterrupted or error-free availability.
Access may occasionally be unavailable due to maintenance, technical issues, third-party infrastructure failures or circumstances outside our reasonable control.
13. Backups
We may maintain backups as part of operating the service, but organisations should not treat PipeBandHQ as the sole archive for information that they are legally or operationally required to preserve.
14. Third-party services
PipeBandHQ relies on third-party technology and service providers for parts of its operation.
We are not responsible for failures or interruptions caused by third-party services that are outside our reasonable control.
15. Intellectual property
PipeBandHQ, including its software, branding, design, functionality and associated intellectual property, remains the property of PipeBandHQ or its licensors.
These Terms do not transfer ownership of PipeBandHQ software or intellectual property to users or organisations.
16. Suspension and termination
We may suspend or terminate access to PipeBandHQ where reasonably necessary, including where:
- These Terms are materially breached.
- The service is being used unlawfully or abusively.
- Payment remains overdue on a paid subscription.
- Access presents a security risk to the service or other users.
Where reasonably possible, we will provide notice before terminating a paid organisation account.
17. Disclaimers
PipeBandHQ is an administrative and organisational tool. Information entered into the service is provided by users and organisations.
We do not guarantee that user-entered information is complete, accurate or suitable for any particular purpose.
18. Limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
To the fullest extent permitted by law, PipeBandHQ will not be liable for indirect or consequential losses, loss of profits, loss of opportunity, loss of goodwill or losses arising from information entered or managed by users.
Where liability cannot be excluded, our liability will be limited to the extent permitted by applicable law.
19. Changes to these Terms
We may update these Terms from time to time as PipeBandHQ develops or where changes are required for legal, regulatory or operational reasons.
Material changes may be communicated through the service or by other reasonable means.
20. Governing law
PipeBandHQ is operated by Matthew Taylor, a sole trader based in Scotland, trading as PipeBandHQ.

These Terms, and any dispute or claim arising out of or in connection with them or with the Service, are governed by Scots law.
The courts of Scotland have jurisdiction over any such dispute or claim. If you use the Service as a consumer and live elsewhere in the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom where you live.
Nothing in these Terms affects any rights you have as a consumer that cannot be excluded or limited by law.
